1. All Contest finalists have been posted on http://www.wttw.com/checkpleasehost (the “Website”) in a manner for public viewing and voting. Only one (1) vote per IP address will be accepted during the Entry Period which commences at 12:00 am Central Time on March 20, 2013 and ends at 11:59:59 pm Central Time on April 17, 2013 (“Voting Period”). Additional votes from the same IP address will be disqualified. All Contest voters must be at least 18 years of age on date of voting. Sponsor’s computer will serve as the official time piece for the Contest.
2. Contest finalists are prohibited from obtaining votes by any fraudulent or inappropriate means including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor (Window to the World Communications, Inc.) in its sole discretion. Employees of Sponsor and each of its parent companies, divisions, subsidiaries, affiliates, advertising, promotion and public relations agencies and their respective officers, directors, employees, representatives, and agencies are not eligible to vote in the Contest.
3. All votes must be entered manually. Votes generated by script, macro or other automated means or which subvert or impair the integrity of the voting process will be void. Any attempt by any Contest finalist and/or his/her family/friends or any other individual to vote using any fraudulent mechanism, (including, without limitation, vote aggregators, vote exchange pages or other third-party means of soliciting votes) as determined by Sponsor in its sole discretion, shall give Sponsor the right to void the votes in question and/or disqualify the Contest entrant in its sole discretion (even if the Contest entrant was unaware of the fraudulent mechanism(s). Sponsor is not responsible for lost, late, incomplete, illegible, incomprehensible or misdirected votes, bugs, failures in servers, hardware or software transmission failure or loss or delayed or corrupted data transmissions or any injury or damage to a voter’s computer related to or resulting from downloading any portion of this Contest. Sponsor is not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by Sponsor the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the votes in this Contest and which may limit a participant's ability to participate as a voter in this Contest.
4. Voters are to choose their “Check, Please!” host based on the contestants video auditions and their answers to the question: Why do you want to host Check, Please!?. Following the close of the Voting Period, WTTW staff members selected by Sponsors and producers of Check, Please! will determine the new host of the series using the vote tally as part of the selection criteria.
5. The Contest and these Voting Rules shall be governed by, construed, and enforced in accordance with the laws of the State of Illinois. All disputes arising out of or connected with the Contest and these Voting Rules will be resolved individually, and without resort to class action, exclusively in either the State or Federal Courts located in Chicago, Illinois, and each voter expressly consents to the jurisdiction of said courts. All judgments or awards will be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in the Contest and shall not include any indirect, punitive, incidental, and/or consequential damages.
Each voter further agrees to not knowingly: damage or cause interruption of the Contest or the Contest voting; prevent others from using the Contest voting procedures; or obtain or modify another voter’s non-public account information without their consent. Submission of a vote is acknowledgment of and agreement to be bound by all terms and conditions of these Voting Rules. In the event of a dispute concerning who submitted a vote, the entry will be declared to have been made by the authorized account holder of the voter’s IP address.
CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST OR THE CONTEST VOTING VIOLATES CRIMINAL AND/OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY CONTEST VOTER MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor shall have the right to modify these Voting Rules in any way or at any time, as long as Sponsor gives reasonable notice.
